First, let's remember that this is Texas, a state that permits killing someone in defense of property and that leads the nation in executions. Second, this case may be the classic example of the prosecutor hiding behind the grand jury. Keep in mind that the prosecutor guides and controls the grand jury - it is a rubber stamp of the prosecutor's actions. There is no double jeopardy with regard to grand juries - the prosecutor can keep trying to indict or proceed with an information. Last, I find it difficult to accept that the members of the grand jury refused to return a true bill after listening to the 9-1-1 tapes and viewing the evidence that the two burglary suspects were both shot in the back.

I know that we differ in our opinion on this topic but I agree with Texas allowing defense of property as a lethal response, at least this gives the property owner a means to protect his property for theives. Had the neighbor attempted to apprehend the suspects he could have been injured or killed by those same suspects. My though is if you do not want to get shot leave other peoples property alone. Back or front good shooting.
