No Reversal on Kennedy v. Louisiana

The Supreme Court on Tuesday voted, 7 to 2, not to reconsider its decision last June that the death penalty is unconstitutional punishment for the rape of a child.

Clearly there is no national trend toward executing child rapists, and the original majority in Kennedy v. Louisiana knew it. If there is a trend, it is in the opposite direction - more states are reconsidering the use of capital punishment since New Jersey abolished it. Public opinion is down and so is the size of death row.
